1. Purpose

This policy expresses KCTCS’ commitment to providing a safe and healthy environment for its employees and students and establishes compliance with the Drug-Free Workplace Act of 1988.

2. Scope

This policy applies to all individuals while they are in facilities or on properties owned, controlled, leased, or operated by KCTCS or conducting KCTCS business.  

3. Policy on Controlled Substances

3.1 Controlled Substances

The unlawful manufacture, distribution, dispensation, possession, or use of controlled substances is prohibited in and on any property owned, leased, or controlled by KCTCS or during the conduct of KCTCS business.  Reporting to work under the influence of unlawful controlled substances is prohibited.

3.2 Prescription Medication

The legal use of prescribed medicines under the direction of a licensed healthcare provider is permitted, provided the prescribed medicine does not impair an employee’s ability to perform his or her job effectively and in a safe manner.  Employees using prescribed medicines should consult with their healthcare provider about the medication’s effect on their fitness for duty and should promptly disclose any restrictions required by the medication to their supervisor and human resources department.  Prescribed medications should be in the original container labeled by a pharmacist or appropriate healthcare provider. This provision and its requirements apply with equal respect to the legal use of medicinal cannabis.

4. Alcohol Abuse 

Alcohol abuse, reporting to work or class under the influence of alcohol, or engaging in the unauthorized consumption of alcohol while on KCTCS property or while conducting KCTCS business, including off-site or remote work, is prohibited.

5. Sanctions

  1. Any KCTCS employee, including student workers, who fails to abide by this policy shall be subject to disciplinary action up to and including termination.
     
  2. Any KCTCS employee found to be in violation of this policy may be referred to an Employee Assistance Program (EAP) and/or rehabilitation program.

  3. Any KCTCS student who fails to abide by this policy is subject to discipline under the KCTCS Code of Student Conduct.

  4. Any visitor to KCTCS property found to be in violation of this policy may be asked to leave or may be removed from the property.
