1. Purpose
This Policy establishes the protection and equal treatment of pregnant persons, individuals with childbirth or pregnancy-related conditions, and new parents.
2. Scope
This Policy applies to all aspects of KCTCS’ programs, including admissions, educational programs and activities, hiring, leave policies, employment policies, and health insurance coverage.
3. Policy
KCTCS is committed to providing a safe and healthy working and learning environment and protecting the ability of pregnant individuals to work and learn at KCTCS institutions. KCTCS shall not require employees or students to limit employment or academic activities due to pregnancy, childbirth, or a related medical condition. The benefits and services provided to individuals affected by pregnancy shall be no less than those provided to individuals with temporary medical conditions.
Individuals with limitations related to pregnancy, childbirth, or a related medical condition are entitled to reasonable accommodations so they will not be disadvantaged in their employment or academic activities. KCTCS will determine on a case-by-case basis whether a requested accommodation is reasonable or would create an undue hardship after considering the nature of the accommodation, its impact on its operations or learning environments, and available resources.
Applicable definitions and process guidance are provided in the associated Procedure.
4. Compliance
4.1
Harassment by any member of the KCTCS community based on sex, gender, gender identity, gender expression, pregnancy, or parental status is prohibited. KCTCS maintains an educational and work environment free of illegal discrimination and harassment based on or relating to gender, race, color, religion (or lack thereof), national origin, age, disability, marital status, sexual orientation, gender identity, genetic information, pregnancy, veteran or social status, social origin, indigenous status, or any other characteristic, trait, or identification protected by law.
4.2
KCTCS employees are prohibited from interfering with a student or employee’s ability to take leave, seek reasonable accommodation, or otherwise exercising the rights granted under this Policy. KCTCS employees are prohibited from retaliating against a student or employee for exercising the rights articulated by this Policy, including imposing or threatening to impose negative educational or employment outcomes because a student or employee requests leave or accommodation, files a complaint, or otherwise exercises their rights under the Policy.
4.3
Dissemination of the Policy and Training. A copy of this Policy shall be made available to employees in their required training and posted on the KCTCS website. KCTCS shall alert all new students and employees to this Policy and the location of this Policy as part of orientation. Notice will be posted in reasonably accessible areas of KCTCS facilities.
4.4
Reporting Policy Violations. Any member of the KCTCS community may report a violation of this Policy in accordance with the Anti-Harassment and Discrimination Procedure 3.3.1-P.
5. Procedure
Administrative Procedure 3.2-P implements this Policy.
